Description of Service

ModelFetch provides a web-based platform that allows users to create, configure, and deploy Model Context Protocol (MCP) servers. The Service includes tools for server configuration, deployment management, and integration with various AI models and context providers.

Use of the Service

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service in any way that violates applicable laws or regulations.
• Deploy MCP servers that contain illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.
• Create or deploy servers that infringe upon the intellectual property rights of others or that you do not have permission to use.
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems connected to the Service.
• Use the Service to process, store, or transmit confidential, sensitive, or personal information without proper authorization and security measures.
• Abuse the Service by creating excessive servers, making excessive requests, or attempting to overload our systems or deployed infrastructure.
• Use deployed MCP servers for cryptocurrency mining, DDoS attacks, or other resource-intensive activities not related to MCP functionality.

Server Deployment and Management

When using our MCP server deployment features, you acknowledge and agree that:

• You are responsible for the configuration and content of your deployed MCP servers.
• You have the necessary rights to deploy and operate the server configurations you create.
• You will comply with the terms of service of any third-party APIs, models, or services integrated with your MCP servers.
• Deployed servers may be subject to resource limits and usage quotas as specified in your service plan.

Content and Intellectual Property

You are solely responsible for ensuring that you have the right to create and deploy MCP servers with the configurations you specify. By using the Service, you represent and warrant that:

• You have the necessary rights to create and deploy the MCP server configurations you submit.
• Your server configurations and deployed content do not infringe upon any third-party rights.
• You will not deploy servers containing copyrighted material without proper authorization.

Service Availability

We strive to maintain the Service's availability and the uptime of deployed MCP servers, but we do not guarantee uninterrupted access. The Service and deployed servers may be temporarily unavailable for maintenance, updates, or due to technical issues beyond our control.

Limitation of Liability

To the fullest extent permitted by applicable law, ModelFetch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any errors in MCP server creation, configuration, or deployment.
• Any downtime, performance issues, or failures of deployed MCP servers.
• Any loss or corruption of server configurations or data.
• Any content obtained from deployed MCP servers or third-party integrations.
• Unauthorized access, use, or alteration of your server configurations or deployed infrastructure.

Intellectual Property

The Service and its original content, features, and functionality are owned by ModelFetch and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You retain ownership of any server configurations and content you create and deploy through the Service.

Data Processing and Privacy

By using the Service, you acknowledge that we will process your server configurations, deployment settings, and related metadata to provide the MCP server creation and deployment services. Please refer to our Privacy Policy for detailed information about how we handle your data.

Termination

We reserve the right to terminate or suspend your access to the Service and any deployed MCP servers at any time, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination, we will provide reasonable opportunity for you to retrieve your server configurations and data.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
